OVERVIEW

This presentation covers the Ethical considerations when using AI, overview of Advisory Opinion 24-1, and future concerns and general guidelines for ethical use.

PRESENTER(S):

Elizabeth Clark Tarbert is Director of the Lawyer Regulation Division for The Florida Bar, the division responsible for the investigation and prosecution of disciplinary complaints against Florida Bar members, since October 2021. She also serves as counsel to The Florida Bar Board of Governors Disciplinary Review, Disciplinary Procedure, and Rules Committees. She was Ethics Counsel for The Florida Bar from 1997-2021, providing oral and written ethics opinions to members of The Florida Bar and advising the Professional Ethics Committee, Standing Committee on Advertising, and Board Review Committee on Professional Ethics. She has also served as counsel to numerous special bar committees and task forces. She currently serves on the ABA Standing Committee on Professional Regulation and is a former member of the ABA Standing Committee on Ethics and Professional Responsibility. She has been an Assistant Public Defender in both Dallas, Texas and the Eighth Judicial Circuit in Gainesville, Florida. While at the Defense Contract Management District Mid-Atlantic, Defense Logistics Agency in Philadelphia, Pennsylvania, Ms. Tarbert worked in a special fraud remedies unit, assisting in the investigation and prosecution of government contractors. Ms. Tarbert graduated from the University of Florida College of Law with honors and holds a Bachelor of Arts degree in Sociology from the University of Florida. She frequently speaks on legal ethics and professional responsibility.

Timothy P. Chinaris is Professor of Law at Belmont University College of Law in Nashville. Professor Chinaris was Ethics Director of the Florida Bar from 1989-1997, where he ran the popular “ethics hotline” service that answers more than 25,000 calls annually from bar members. Effective July 2023, Professor Chinaris joined Smith, Tozian, Daniel & Davis as “of counsel.” Professor Chinaris holds bachelors and masters degrees from Florida State University, and received his J.D. With Honors from the University of Texas School of Law. He is admitted to practice law in Florida, Tennessee, Alabama, and Texas. Professor Chinaris consults with and represents lawyers and others on a wide variety of professional responsibility issues, including lawyer advertising and bar admission matters. His legal ethics website is “sunEthics.com.” He co-authored the authoritative treatise FLORIDA LEGAL MALPRACTICE AND ATTORNEY ETHICS (ALM 2017) (with Warren Trazenfeld and Robert Jarvis). He has served as an expert witness in various legal ethics matters, including for the prevailing party in the first case decided under the Sarbanes-Oxley Act. Active in professional organizations, Professor Chinaris has chaired both the Florida Bar Professional Ethics Committee and the Florida Bar Standing Committee on Professionalism. Professor Chinaris currently chairs the Tennessee Bar Association Ethics and Professional Responsibility Committee, and is President of the Florida Supreme Court Historical Society. Professor Chinaris has also been active in public service. He served as an Ethics Commissioner for the State of Alabama and as a Trustee for the Jacksonville, Florida public library system.
